Terms of Service

1. Agreement and community documents

These Terms of Service ("Terms") govern your use of the Lakes of Las Colinas HOA website, ResidentHub portal, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms and our Privacy Policy.

The community's declaration, bylaws, rules, resolutions, amenity agreements, and other governing documents remain controlling. ResidentHub is an administrative tool and does not amend, waive, or replace them.

2. Eligibility and accounts

Public visitors may use only the public portions of the Services. Resident-only features require an approved account and, where applicable, verified property, ownership, occupancy, committee, or reviewer eligibility. You must provide accurate information, protect your credentials, and promptly notify us of suspected unauthorized use. You may not share an account or attempt to access another person’s information or features.

We may verify identity, household, property, and role information before granting or continuing access. We may correct, suspend, or restrict an account when reasonably necessary for security, eligibility, community operations, or enforcement of these Terms and governing documents.

3. Permitted use

You may use the Services only for lawful community purposes and in accordance with these Terms and governing documents. You must not:

• submit false, misleading, infringing, unlawful, or harmful information;
• interfere with the Services, bypass security, probe for vulnerabilities, or attempt unauthorized access;
• impersonate another person, misuse another resident's information, or use the Services for spam or unauthorized commercial solicitation;
• upload malware or content you do not have the right to submit; or
• use information from the portal for a purpose inconsistent with its stated community use or another person's privacy choices.

4. Requests, reservations, and community decisions

ResidentHub may allow you to submit requests for maintenance, parking, architectural review, visitor access, reservations, violations-related materials, governance acknowledgements, or other community services. A submission is not an approval. Decisions remain subject to the relevant workflow, community authority, governing documents, availability, fees, and applicable law.

You are responsible for reviewing the status of your request and any notice or conditions provided through the Services. Community staff, committees, and administrators may request additional information, deny, approve with conditions, or close a request consistent with their authority and the applicable rules.

5. Your content and evidence

You retain your rights in content you submit. By submitting information, photos, documents, or other materials, you represent that you have the necessary rights, permissions, and authority to provide them. You grant Lakes of Las Colinas HOA a limited, non-exclusive license to host, reproduce, review, share with authorized community participants and service providers, and otherwise use the material solely to operate the requested Service, administer the community, and meet legal or recordkeeping obligations.

Do not upload sensitive or unrelated personal information. We may remove or restrict content that violates these Terms, governing documents, law, or another person's rights.

6. Homes For Sale placements

Homes For Sale is a paid community placement directory that may link to an external real-estate listing. It is available only to eligible active owners or co-owners for their own property, subject to review, package selection, payment verification, and expiration. A public placement is not published until its required review and payment steps are complete.

ResidentHub does not act as a real-estate broker, agent, MLS, escrow provider, lender, title company, or buyer-inquiry service. We do not verify listing accuracy, pricing, property condition, ownership, or the content of external listings, and we do not endorse any listing. You are responsible for complying with applicable law, brokerage obligations, MLS rules, and any governing-document requirements. Fees and payment status are handled under the package shown at checkout or manual-verification workflow; except where required by law or expressly stated, fees are nonrefundable.

7. Payments and third-party services

Some Services may involve a fee or third-party provider. You authorize us and our payment processor to process the amount disclosed before payment. Third-party websites, payment processors, maps, calendars, and external listing sites have their own terms and privacy practices. We are not responsible for third-party services that are not under our control.

8. Privacy

Our Privacy Policy explains how we collect, use, and share personal information. Your choices in directory, notification, and public-listing features affect how information is displayed within those features.

9. Availability and changes

We may modify, suspend, or discontinue a feature when reasonably necessary for maintenance, security, legal compliance, community operations, or improvement. We will not intentionally delete your community records merely because a feature changes, but record retention remains subject to the Privacy Policy, governing documents, and law.

10. Disclaimer and limitation of liability

To the extent permitted by law, the Services are provided "as is" and "as available." We do not guarantee uninterrupted availability, error-free operation, or that information submitted by other users is complete or accurate. The Services are not legal, financial, title, insurance, safety, real-estate, or emergency advice. In an emergency, contact 911 or the appropriate emergency service rather than relying on ResidentHub.

To the extent permitted by law, Lakes of Las Colinas HOA, its board members, committees, management, volunteers, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of, or inability to use, the Services. Nothing in these Terms limits liability that cannot lawfully be limited.

11. Indemnity

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Lakes of Las Colinas HOA, its board members, committees, management, volunteers, and service providers from claims, losses, or expenses arising from your unlawful use of the Services, your breach of these Terms, or content you submit in violation of another person's rights.

12. Governing law and disputes

These Terms are governed by Texas law, without regard to conflict-of-law rules, except where applicable law requires otherwise. Any dispute relating to the Services will be handled in the state or federal courts with jurisdiction over the community, unless the governing documents or applicable law provide a different process.

13. Changes to these Terms

We may update these Terms to reflect changes to the Services, community operations, or legal requirements. We will post the updated Terms and revise the effective date. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
